An unsettled legal issue arises after someone is facing multiple third or subsequent offenses for DWI in Belmar. Each offense would normally be punishable by a minimum 6 month jail term. However, it has been held unconstitutional to sentence a person to more than 6 months in jail without a jury trial in the State of New Jersey.

State v. Federico decided, last year, held that no one can be sentenced to more that 6 months incarceration in New Jersey for charges that stem from a single case. However, Federico did not address whether individuals who face multiple charges from separate cases can be sentenced to more than six months without a jury trial.
