The “K-Visa,” commonly known as the a fiance-visa, is specifically available to the foreign-citizen fiancé of a United States citizen (“USC”). A K-1 visa allows the foreign-citizen fiancé to apply for entry at a Border or entrance point to the United States with the intent to marry his or her USC sponsor within 90 days of entry. The foreigner/ alien husband or wife must then apply to change his or her immigration status to a permanent resident (Green Card Holder). Children of the K-1 holder may accompany their father or mother with a “K-2″ visa, if otherwise eligible.
